Who it applies to"Agency" in § 86(3): any state or municipal department, board, bureau, division, commission, committee, public authority, public corporation, council, office or other governmental entity performing a governmental or proprietary function for the state or any one or more municipalities thereof, except the judiciary or the state legislature.
Time limit to respond5 working days (Public Officers Law § 89(3)(a)). The due date is calculated when the request is entered, with the holidays of the jurisdiction.
ExtensionsUp to 20 working days. Not an extension in the statute's words: within the 5 business days the agency may instead acknowledge the request in writing with an approximate date, reasonable under the circumstances, when it will be granted or denied. If the agency decides to grant in whole or in part and cannot disclose within 20 business days from the date of the acknowledgement, it must state in writing the reason and a date certain, within a reasonable period, when the request will be granted.
